Disabled Veteran Exemption Information

The Division of Veteran Affairs will be sending approval letters to veterans at the same time they are sending approved veteran applications to each assessor’s office. The assessor’s office will also receive a list of approved disabled veterans.
According to the Colorado State Department of Property Taxation, if the Disabled Veteran Exemption application is not completed correctly, or if the veteran did not meet the ownership requirements, the application must be denied.
Individuals who missed the July 1 application deadline may request that the Division of Veterans Affairs waive the application deadline and file a late application no later than September 1. Veterans must contact the Department of Veteran Affairs directly to initiate this request.

The implementing legislation for the Disabled Veterans Exemption, HB07-1251, was signed by the Governor on April 15, 2007. The legislation can be viewed on-line at the Colorado General Assembly website.
The Colorado Division of Veterans Affairs (CVA) and the Governor’s Office have been conducting an extensive outreach campaign to notify as many qualifying veterans as possible. The CVA is in the process of mailing information about the program to each of the likely candidates that they are aware of. They have also been working with county veterans service offices and veterans organizations throughout the state. The Governor’s Office will soon be issuing press releases about the new program.

The application deadline is July 1.
Status as of March 15, 2007
The Colorado Constitution is in the process of establishing a property tax exemption for qualifying disabled veterans. The status of this legislation (House Bill 07-1251) is that it has passed the House and the Senate Finance Committee. It currently awaits a hearing in the Senate Appropriations Committee. The Colorado Division of Property Taxation, the Division of Veteran’s Affairs and the Department of Military and Veteran’s Affairs are in the process of determining how the program will be administered.
Preliminary determination indicates the legislation will require the veteran to make application to the Division of Veteran’s Affairs. The Division will then make a determination on whether the applicant is a “qualifying disabled veteran”. If so, the Division will send a copy of its determination to the Assessor and the applicant, along with a copy of the application. (For denials, only the applicant will be notified.)
Once the Assessor is notified by the Division of Veteran’s Affairs, the Assessor will then determine whether the applicant meets the definition of “owner-occupier”, and did so on January 1. If so, the Assessor will place the exemption on the property.
The application deadline and subsequent deadlines have been changed slightly to provide enough time for the two-step process to work. Assessor denials on the “owner-occupier” criteria can be appealed to the County Board of Equalization, but the Division of Veteran’s Affairs denials of the applicant’s status as a “qualifying disabled veteran” cannot be.
There will be a form in place soon after the legislation is finalized. This form will be available from the Division of Veteran’s Affairs, the Division of Property Taxation, and the County Assessor. The Division of Veteran’s Affairs will be sending a form to all the likely qualifying veterans that they are aware of.
For those who qualify, 50 percent of the first $200,000 in actual value of their primary residence is exempted, for a maximum exemption amount of $100,000 in actual value. The State of Colorado pays the property taxes on the exempted value.
