Board of Adjustments

The  Board of Adjustments is a voluntary citizens group appointed by the Board of County Commissioners. Board of Adjustment members don’t formally represent specific geographic areas of the county or specific disciplines. However, the group usually includes members from a range of communities and backgrounds.  The Board meets as needed, so does not have regularly-scheduled meetings.

The Board of Adjustments is responsible for reviews that involve:
  • GRANTING OF VARIANCES FROM SETBACK REQUIREMENTS. To grant variances from setback requirements where, by reason of unusual narrowness, shallowness, or shape of a specific parcel existing as of the January 8, 2001 or by reason of unusual topographic conditions or other situations or conditions of the parcel, none of are self-imposed by the property owner, the strict application of the requirements of the Gunnison County Land Use Resolution Section 13-104: Setbacks from Property Lines and Road Rights-of-Way would result in "peculiar practical difficulties" to, or undue hardship upon the owner of the property. The Board of Adjustments may grant a variance to relieve those difficulties or hardship, if such relief may be granted without substantial detriment to the public health, safety and welfare and  "without substantially impairing the intent and purposes of the Resolution."
  • APPEAL OF ACTION BY PLANNING DIRECTOR. To hear and decide appeals when it is alleged by an applicant that the Planning Director has made an error in any order, requirement, decision or refusal related to the granting of variances from the Gunnison County Land Use Resolution's setback requirements, Section 13-104: Setbacks from Property Lines and Road Rights-of-Way.
A hard copy of the variance application form is available in the Planning Department; a .pdf version is available HERE.
