Public Trustee

Mission

The mission of the Gunnison County Treasurer and Public Trustee Office is to provide revenue and foreclosure services to the public, taxing authorities, and parties to foreclosures, so they can pay and collect taxes and other revenue in an accurate and timely manner and experience a fair and timely foreclosure process.

NOTICE

Beginning July 1, 2025, the fee for a Release of Deed of Trust will be $73.00.

This amount includes the Public Trustee Fee and recording costs.


NEW FORECLOSURE SALE FEE!

Beginning July 1, 2024, any property sold to a 3rd party at the Gunnison County Foreclosure Sale will be required to pay a $300.00 fee. This fee is over and above the winning bid amount. The fee is pursuant to C.R.S. 38-37-104(1)(b)(XIII).

The Community Economic Defense Project is a Colorado-based non-profit organization that offers free financial assistance to eligible homeowners who are behind on their mortgage, utilities, HOA fees, property tax, lot rent and homeowners insurance through the Emergency Mortgage Assistance Program.

Notice to Homeowners

If your property goes to a foreclosure auction sale and is purchased for more than the total owed to the lender and all other lien holders, please contact the Public Trustee's Office after the sale because you may have funds due to you.

In addition, be aware that ownership of the property will not transfer away from you until at least eight business days after the actual foreclosure sale, which may occur at a date later than the initial sales date indicated on the mailed notice you receive from this office. There is no reason to vacate your home before the actual foreclosure sale.

IF THE BORROWER BELIEVES THAT A LENDER OR SERVICER HAS VIOLATED THE REQUIREMENTS FOR A SINGLE POINT OF CONTACT IN SECTION 38-38-103.1 OR THE PROHIBITION ON DUAL TRACKING IN SECTION 38-38-103.2, THE BORROWER MAY FILE A COMPLAINT WITH THE COLORADO ATTORNEY GENERAL, THE FEDERAL CONSUMER FINANCIAL PROTECTION BUREAU (CFPB), OR BOTH. THE FILING OF A COMPLAINT WILL NOT STOP THE FORECLOSURE PROCESS.

The properties that appear on the weekly sale/auction lists located on the Foreclosure Property Search page are timely and valid only as of the date and time they are posted. However, changes in the sale/auction list can occur at any time prior to the acceptance of the final bid at a specific property on the list.

Continuances of sales may be made up to the time of sale and the "post sale list" can change if a sale is rescinded after the sale date according to the law.
